The guy is actually a bit in front-right of him in the fourth panel, so he could have very easily (although stupidly) moved forward in the fifth panel. :) Admittedly, action/busy scenes aren't my strong suit, so I'm sure there are pleeeeenty of errors to go around.
Henchmen-R-Us doesn't have sales, as we pride ourselves in providing top-of-the-line henchmen. These guys are clearly from Hench-Mart, one of our leading competitors. Low quality and cheap henchmen are their backbone.
